BRATISLAVA, January 10, (WEBNOVINY) — Prosecutor of the Povazska Bystrica District Prosecutor’s Office Tibor A., accused of two instances of power abuse and indirect corruption confessed to one less serious deed immediately at the beginning of the main court session. The deed in question involves accepting money for arrangement of delivery of a prosecution warrant to his co-defendant Daniel R. to Germany. Tibor A. denied committing other deeds in front of a judge of the Specialized Criminal Court pleading not guilty. The term of the accused prosecutor has been suspended.
In the deeds he is accused of, Prosecutor Tibor A. withdrew a legitimate and well-founded protest of a district prosecutor against a ruling of the City Council in Povazska Bystrica from December 29, 2006, which facilitated election of two council members as deputy majors [which was a violation of the applicable laws — SITA note], according to an arraignment from February 14, 2007. The defendant claims that the City Council rectified the violation of the law in January 2007 although, as the prosecutor claims, the defendant knew there was still a discrepancy between the minutes and the audiovisual record from this council meeting. The prosecutor claims that Tibor A. took such course of action with the aim to preserve the unlawful state and reduce the degree of penal responsibility of two people, who were to be suspected of acting in conflict with the law on municipal establishment.
Another criminal deed of the defendant concerns Tibor A. and Daniel R. accepting a bribe of EUR 1,000 over a telephone call, according to the prosecutor. Daniel R. who was temporarily living in Germany, wanted the defendant to arrange with a judge that his prosecution warrant would be delivered to him to Germany while his local address would remain undisclosed. Tibor A. sent the co-defendant a text message with a number of his account and received EUR 600 to his account.
The prosecutor further accuses Tibor A. of procuring offense records of city’s District Office based on a request of a private businessman in September 2007. The defendant handed the documents over to the businessman with the aim to discredit one suspicious character already in office of head of the Povazska Bystrica City Council.
The fourth deed in the lawsuit concerns a bribe of SKK 40,000 that lawyer Marcel P. promised to Tibor A. for influencing Mayor of Povazska Bystrica Miroslav Adame and persuading him to give up an option for the purchase of one real estate in favor of a new owner.
