BRATISLAVA, May 25, (WEBNOVINY) — Restructuring of the national betting company Tipos has been definitely halted. The ruling of the District Court Bratislava I, which permitted withdrawal of the proposal for the start of restructuring, was published in the Commercial Bulletin on Wednesday. This ruling cannot be appealed and it was considered delivered on the day of its publication in the Commercial Bulletin.
The national betting company Tipos decided to withdraw the restructuring proposal after the Constitutional Court had accepted their constitutional complaint contesting the decision of the Supreme Court appellate panel in Tipos’ legal dispute with the Cypriot company Lemikon Limited. The Constitutional Court at the same time ordered suspension of the executability of the verdict of the Supreme Court appellate senate, which imposed the duty on Tipos to pay over EUR 14 million to Lemikon. In the constitutional complaint Tipos at the same time proposed postponing the executability of associated decisions of lower courts.
Originally, Lemikon claimed from Tipos 66 million euros for alleged unauthorized use of its know-how and trademarks. The Supreme Court ruled in November of last year in an extraordinary appeal filed by Prosecutor General that Tipos should pay Lemikon 14 million euros for unauthorized use of trademarks, and accepted the prosecutor’s appeal in the other points and returned the case back to lower courts to decide. Already in 2008 based on the original decision of the Supreme Court and a subsequent out-of-court settlement with Lemikon, Tipos paid the Cypriot company 16 million euros.
The legal dispute between the Czech lottery company Sportka and Tipos began in 2000, when Sportka accused Tipos of using its know-how and trademarks without authorization. Later in 2008, Sportka sold its claim to the Cypriot company Lemikon.
National lottery company TIPOS was established in January 1993. Its sole shareholder is the Slovak Republic represented by the Ministry of Finance.
