Cabinet Passes Deputy Amendment to the Law on Highways

BRATISLAVA,June 22, (WEBNVINY)- On Wednesday, the Cabinet approved the draft amendment to the 2007 law on extraordinary one-off measures in construction of highways and dual carriageways, submitted by four members of the MOST-HID deputy caucus for the OKS party. The deputies suggest in the amendment to omit stipulations from the original legislation that are in odds with the Constitution based on the Constitutional Court’s verdict from earlier this year, as well as stipulations closely related to them. Construction of highways on land with unresolved property rights, which the current wording of the law allows, should end once the new draft is passed.

The Ministry of Transport, Construction and Regional Development recommended the Cabinet to approve the draft deputy amendment with a condition that in the next legislative process in parliament, changes and supplements proposed by the Transport Ministry will be incorporated.

“Until the Constitutional Court’s verdict is published in the Collection of Laws, it is premature to submit any amendment to the law, as a legislation that will be in odds with the court’s verdict could be adopted,” the ministry explained. The Constitutional Court’s rulings take effect as of their publication in the Collection of Laws.

Parliament is to debate the draft amendment to the law on highways at the upcoming twentieth parliamentary session starting June 28. If the draft is approved, it is to take effect as of the date of its publication in the Collection of Laws.
