Dobroslav Trnka Turns to Constitutional Court over Vote

KOSICE, August 3, (WEBNOVINY) — Ex-Prosecutor General Dobroslav Trnka has filed a complaint with the Constitutional Court as he is discontent that parliament has failed to submit a proposal for his installing to the prosecutor general post after the May 17 election, in which he won the support of the simple majority of MPs present at the vote. In his complaint he filed as a private person, Trnka objects what he deems incorrect evaluation of the outcome of the vote in parliament. The spokeswoman for the Constitutional Court Anna Pancurova confirmed that they have registered the complaint and that it has been already assigned to the judge-rapporteur. The Constitutional Court received Trnka’s complaint on July 14.

In his complaint Trnka objects to the parliament’s alleged violation of his basic right to access to elected and other public office under equal conditions and the right to enter public service of his own country without any differences and unjustified restrictions. According to Trnka, parliament has infringed his rights by not submitting a proposal to appoint him into office, by its inactivity.

Trnka also says that parliament has violated his basic right to access to elected and other public functions under equal conditions and his right to enter public service of his own country under equal conditions without any differences and without unjustified restrictions by its voting on the prosecutor general election also on June 17. He objected that the parliament proceeded according to the provisions of Article 39 Section 8 of the parliamentary rules of procedure and thus disrespected the Constitutional Court’s decision on effectiveness of this provision.

Parliament elected Jozef Centes in a secret ballot as the new prosecutor general on June 17. His rival, Dobroslav Trnka, withdrew consent with his candidacy just before the election. However, Centes still needs to be appointed to office by President Ivan Gasparovic .The head of state, however, remains reluctant to do so and describes the election as politicized. On June 29, the Constitutional Court canceled its injunction issued June 15 when it suspended certain provisions of parliamentary rules of procedure concerning the election of a prosecutor general. These rules enabled changing a secret ballot to elect a prosecutor general to a public vote, which was contested by acting Prosecutor General Ladislav Tichy. The ruling coalition voted to revamp these rules as it was unable to elect a new prosecutor general in a secret vote when some of its deputies whose identity have not been revealed to date raised their hands for Trnka.
