BRATISLAVA, May 3, (WEBNOVINY) — Transparency of decisions made by the Prosecutor General’s office cannot improve its operation, opines Ladislav Tichy, First Deputy Prosecutor General and Acting Prosecutor General. “I do not know a country in the whole Europe or even other systems as the Anglo-American, they do not publish decisions of police authorities and prosecutors, either. An inquisition principle is in effect, only courts act verbally and publicly, not a prosecutor and a police officer,” stated Tichy following the session of the Parliamentary Constitutional and Legal Committee, which debated the draft amendment to the law on prosecution. The acting prosecutor general thinks that such principle could complicate the lives of innocent people.
Justice Minister Lucia Zitnanska (SDKU-DS) wants to use transparency to generate pressure on stereotypes in the judiciary as well as prosecution. “We have found out something: the system is formed by written rules and also unwritten rules in the heads of people who put them in effect; the stereotypes of their operation are so strong that they roll over the good intention of the lawmaker,” she stated at the committee’s session.
Tichy objects to the draft amendment as a whole, as it was prepared without the participation of the General Prosecutor’s Office. He added that the prosecution is aware of certain shortcomings and has had its own amendment ready for two years. According to him, Parliament should wait with amending the law until the new prosecutor general is elected. Parliament is to debate it at the upcoming parliamentary session starting May 17.
