Prosecutor Appeals Kotleba‘s Court Acquittal

BRATISLAVA/BANSKA BYSTRICA, January 4, (WEBNOVINY) – The prosecutor has appealed against the verdict of the District Court in Banska Bystrica in the case of objectionable text on election leaflets of Marian Kotleba, former leader of far right nationalist organization Slovenska pospolitost. The appeal will be heard by the Banska Bystrica Regional Court.

The prosecutor filed a lawsuit against Kotleba for a text on an election leaflet distributed in 2009, when Kotleba ran for the office of Banska Bystrica County Chairman. In the text, he promised to “eliminate unfair advantages for not only the Gypsy parasites.“ In this way, according to the prosecutor, Kotleba has committed a criminal offense of defaming a nation, race or confession.

According to a blog of Slovenska Pospolitost, an organization previously led by Kotleba, the court wrote in its reasoning that the prosecution’s case was unjustified and the file contained no evidence, proving that the criminal offense had actually been committed. The prosecutor does not agree with the position of the court. “I consider the evidence submitted to be sufficient,” the prosecutor told SITA news agency on Tuesday.
