Court Acquits Accused Hackers in NBU Case

BRATISLAVA, October 14, (WEBNOVINY) — On the final day of the trial of two suspects in the case of hacking of servers of the National Security Office (NBU) four years ago, the prosecutor proposed a conditional one year sentence suspended for two years for Jakub C. and Patrik L. According to media reports from four years ago, they managed to penetrate the servers using the simple password nbusr123.

In his closing speech Prosecutor Jan Santa „acknowledged“ their activity in this case. „The accused have done a piece of positive work, as they uncovered gaps in the NBU system,“ he said. According to him, this led to better security of the servers. „It is not a waste of words to say that everything bad is good for something,“ said Santa. However, as the accused have not regretted their action, they did not confess, they reject any blame, thus according to prosecutor it is not possible to refrain from some sort of punishment.

The prosecutor stated that according to him the evidence in this case has not changed in comparison with the one when the court sentenced the accused by a penal order [without a full trial — editor’s note] to a conditional one year sentence suspended for two years, against which they both appealed. According to the prosecutor, it was proven that there was a wide penetration into the NBU network and when the accused found the password they scanned the whole server and modified some programs. „The servers had undoubtedly been hacked,“ the prosecutor said. According to him, it was done through one school server. “No material damage or other loss was caused, but there was moral damage to this office through certain type of reporting about the case by the press and the hacker community,“ the prosecutor said. He pointed out the suspects are not some amateurs but undoubtedly persons acquainted with the issue and studying given fields. One of the accused worked on the implementation of the server in the school through which was the NBU servers were hacked. He argued that in some files on the server which the community of hackers visit contain data that connect the accused with his nick BR. On other pages data was „forgotten“ that identify the second accused and connect him with the nick TUXO. Both nicks were used to report the hacking of the NBU servers.

The trial continued with closing speeches of the accused and their lawyers. The defense lawyer of Jakub C. said the prosecutor’s closing speech was suggestive, misleading, and false. The two suspects were accused of violating confidentiality of transferred messages and damaging and misuse of data on a memory device.

The court acquitted Jakub C. and Patrik L. and they were cleared of all charges. Bratislava 5 District Court judge reasoned the verdict that it could not be proven that the deed actually happened. „I do not know whether you did it, but according to the evidence it is not clear if it was you who were presented under the nicks BR and TUXO,“ the judge said. The prosecutor appealed against the verdict.
