Cabinet OKs Draft Canceling Transgression Immunity for MPs

BRATISLAVA, June 29, (WEBNOVINY) — The Cabinet voted to support a proposal to cancel immunity concerning transgressions committed by constitutional officials. The authors of the proposal are MPs for the ruling coalition Jozef Kollar, Jozef Mikus, Pavol Hrusovsky and Laszlo Solymos. They suggest adjusting the paragraph in the law on transgressions about launching transgression proceedings against a parliamentary deputy, a Constitutional Court judge, a judge and a member of the Slovak Cabinet. If such person does not agree with proceedings to be launched on site, a written record will be made and the case will be advanced to the administrative body. If the responsible body dealt with the transgression committed by an MP or a judge, s/he will not be disciplinarily prosecuted in the case. The authors propose that the draft comes into effect on September 1.

Interior Minister Daniel Lipsic has submitted the deputy proposal to the Cabinet. His department recommends omitting judges and Cabinet members from the proposal, since they are not shielded by transgression immunity from prosecution. As for Constitutional Court judges, their cases are solved in line with the law on the court’s organizational structure. .

Currently it is possible to open transgression proceedings only in MPs‘ cases involving driving under influence and rejection of blood alcohol tests when they drive a car.
