Cabinet Passes Draft Revision to Citizenship Act

BRATISLAVA, January 26, (WEBNOVINY) — The Cabinet on Wednesday okayed the revision to the “anti-law” on the state citizenship of the former government of Robert Fico. Based on the revised legislation, Slovak citizens will not lose Slovak citizenship after being granted citizenship of another country based on their expression of will. Although the revision was drafted by ruling coalition deputies, it is still unclear in what form it will eventually be passed in parliament.

The legislative material prepared by MPs from SaS, MOST-HID and SDKU-DS parties also includes a new provision, according to which Slovakia will not recognize obtaining citizenship of a foreign country if a citizen receives it at odds with international law, customs, and principles. Based on the Cabinet-approved revision, people who lost Slovak citizenship under the “anti-law” of the previous government can regain Slovak citizenship in a much simpler way. Politicians from KDH as well as parliamentary opposition call such revision purely declaratory since foreign laws are not applicable in Slovakia anyway. Chairman of Parliamentary Constitutional and Judicial Committee Radoslav Prochazka of KDH opines that such provision could in part make mockery of the Slovak legal system.

The Cabinet adopted a draft amendment to the law on civil service of members of the police, intelligence service SIS, Correctional and Judicial Guards Service and the Railway Police, prohibiting dual citizenship for employees of the security forces. According to the draft, individuals with dual citizenship cannot serve police officers, SIS members, soldiers, prosecutors, customs officers, members of the Correctional and Judicial Guards Service, in the Railway Police and in the National Security Office. The authors of the draft, coalition KDH MPs Radoslav Prochazka, Pavol Abrhan and Pavol Hrusovsky, object to the fact that when an individual obtains the citizenship of another country, they have to pledge allegiance to another state to protect it, to serve the country and to obey its laws and constitutionality. At the same time, they promise loyalty to the Slovak Republic.
